You got the TNVS and LTFRB Accreditation, so what’s Next?
Warning: This is a lengthy post. It’s up to you if you want to invest the time to learn more about the business you are in (or plan to be in). We’ve tried to simplify this as much as possible while not holding back on information that you need to know.

What does it really mean to be “accredited and regulated by LTFRB”?
First, let’s understand that as an Uber Partner or GrabPeer, you are now to become a business owner. Yes, remember you registered a business name with DTI? That’s a sole proprietorship. And we are now “independent contractors” of Uber. This means Uber is our client in our TNVS business and we provide our transport services to their riders. It doesn’t stop here, it’s just the tip of the iceberg.
So what if I registered a business name with DTI?
As an operating business entity, you have to register it with BIR. Before you swear and get hysterical and all, it’s just lawful guys. As much as we hate it as well, we need to pay what is due to the government because we are already operating as a business entity.
Also, you signed this, remember? This is in the Terms and Conditions of the Motion for Provisional Authority and/or CPC Franchise you signed.
It doesn’t matter how many or few vehicles you operate. You now have to pay taxes as a business entity. —Surprise! Surprise! This means you need to register with BIR. In case you don’t know; declaration and filing of taxes is on a monthly, quarterly, and yearly basis. You can also refer to this article in Inquirer about the issue.
I thought Uber already paid for my taxes?
Hate to burst your bubble dude but NO.
Uber takes the 20% from our gross fares as their transaction fee. This does NOT yet include our taxes as partners. Don’t worry, Uber as an accredited TNC will also pay for their taxes— from the 20% transaction fee they got from us.
So technically, the remaining 80% of the gross fare we receive via Payout is our income as business entities and as independent contractors of Uber. Understand that it is, by law, our responsibility to pay for our taxes as business entities accredited as TNVS. Uber will most likely NOT process the filing and remitting of our taxes for us (well, we hope they do). We asked them via email and they replied that partners are responsible for their taxes given that we are “independent contractors”.
In your Payment Statement, you’ll notice that there’s “Taxes” indicated there. Those are for information purposes only. That does NOT mean they paid for our taxes (we wish!). It doesn’t also mean that the indicated amount is the amount you’ll need to pay to BIR. There are certain calculations and deductions that you can make to lower your income taxes. Refer to the portion about “how much do I need to pay” below.
So I hope we established that—Uber has NOT yet paid our taxes. It’s our responsibility as “independent contractors”.
Before you brush this issue off, thinking you can get away with it, think again.
As per the LTFRB Memorandum, the TNCs (i.e. Uber and Grab) are required to give reports to the pertinent government agencies when they request for it. This means LTFRB, LTO, and DOTC can ask for the list of partners, drivers and vehicles; BIR can request for the list of name of the operators including our gross payouts. Since Uber and Grab are all based on an online system, it’s very easy to do auditing and targeting of specific partners & drivers. Also, failure to update your filings, declarations, and tax payments are subject to A LOT of penalties (on top of the actual payments you needed to pay).
So if you plan to deal with it later on or not deal with it at all, it’ll just be MORE—WAY MORE expensive! (coming from first hand experience) 🙁
OK, not so bad, I’ll register with BIR. But before you register with BIR, you need to register first with your Local Government Units (LGU) for your Barangay Permit and Mayor’s Permit. OK, now you can swear but don’t forget to read until the end to know all the requirements.
How much do I need to pay in taxes?
As a sole proprietorship, you are subject to taxes. We are subject to two types of taxes that we BOTH need to pay:
- Percentage Tax—depends if VAT or NON-VAT
- Income Tax—depends on your tax bracket after computing for your
Gross Taxable Income = Total Taxable Business Income (from your business) + Compensation Income (from your employer)
But the income tax depends on the amount of the sole proprietor’s earnings. There’s what we call a tax table where the accountants calculate the amount of tax we need to pay. There are also allowable deductions to lower our taxable income. Our expenses related to operating the business are allowed deductions from our gross earnings. This will lower your total taxable business income. We can deduct the gas expenses, car maintenance, cellphone load, driver salary, car amortization, etc.—Yes! Thank you Lord!
How about the “incentives” from the TNCs, are those taxable?
Technically, YES. They will come in to your book of accounts as income from the TNCs. In the books of the TNCs these will be written off as (marketing) expenses. But why?! My incentives from my employer is non-taxable. Yes but we are NOT the employees of the TNCs. Remember, we are “independent contractors” with separate business entities.
Don’t despair yet, again, there are legal ways to minimize your taxable income. As a sole proprietorship business, there are allowable “exemptions” you can use to further lower your taxable income. It depends on how prudent and sharp your accountant is. Before we go further down the drain about taxes, we’ll cut it here as we’ll cover that in a separate article. What we’d like you to know is that there are LEGAL ways to minimize your income taxes. Watch out for that article!
How often should I file/declare and remit to BIR?
As a business entity, you are now required to do monthly, quarterly and yearly filings of your income taxes. Yes, this can be too “taxing (pun intended) for us Partners and Drivers. So, we want to help you.

I’m currently employed. How does this affect me?
Most of you might ask, the TIN I gave was from my employment and that my employer files my taxes, do I still need to do this? YES.
FYI, you are now classified by BIR as a “mixed income earner”. You need to update your record with BIR to reflect these changes. If you think you can bypass this, think again, you gave Uber your TIN, right? Ate Kim can easily trace you.
Btw, let me remind you that it’s illegal to have two (2) TIN per person. It’s a criminal liability. So if you think you don’t have a TIN try to check with BIR, call first. If you’ve been employed at least once before or you’ve contributed in SSS, Philhealth—most probably YOU HAVE AN EXISTING TIN.
So what should you do as a mixed income earner? You need to Update your records with BIR.
How to do this? Refer below “how do I register with BIR”
How do I Register with BIR?
- Fill-up BIR Form 1901 Application for Registration (Sole Proprietor). Download here.
- Bring this to the Regional District Office (RDO) where your business is located/registered.
- Submit the accomplished form with these requirements:
- Certificate of Registration from DTI
- Barangay Clearance
- Mayor’s Permit
- Proof of Address (Contract of Lease or Certificate of Ownership)
- Copy of 2 Valid Government IDs (Passport, License, PRC, SSS, etc)
- Birth Certificate
- Pay for your Registration. Fill in BIR Form 0605
- Register your book of accounts and receipts/invoices.
- Get your Certificate of Registration—BIR Form 2303
Congratulations! Or Not.
IMPORTANT NOTES:
- Don’t forget to print Official Receipts within 30 days of your application, even if we don’t issue receipts to the riders. There’s penalty of Php 1,000 if you missed this; this applies to all types of businesses. Printing of Official Receipt from an Authorized Printer will cost around Php 2000 for the minimum lot.
- Also, don’t forget to have your book of accounts ready for registration. There’s also penalty if you don’t register it with BIR within the deadline. Better bring 3 ledgers (columnar journal, records journal) you can buy at any bookstore and have it stamped registered in BIR.
Are we now required to issue receipts? Uber and Grab emails the receipts on our behalf, right? Yes.
Most probably, Uber and Grab would be required by BIR to have their e-receipts registered with BIR for faster and easier implementation.
How do I get Mayor’s Permit aka Business Permit?
In getting business permits, requirments depend per LGU, but here’s a general flow:
- Go to the Municipal Office where your business is located.
- Accomplish the Application Form for Mayor’s Permit
- Submit accomplished form with these requirements:
- Certificate of Registration from DTI
- Business Barangay Clearance/Permit
- Proof of Address (Contract of Lease or Certificate of Ownership)
- Copy of 2 Valid Government IDs (Passport, License, PRC, SSS, etc)
- Community Tax Certificate (Cedula)
- Fire Permit
- Sanitary Permit
- Get your Mayor’s Business Permit and Licenses
Some LGU will enforce inspecting your registered business address before they release your Fire and Sanitary Permits. It usually takes about 7days to get all these done. And spend around Php 1000 varies per LGU.
How do I get Business Barangay Clearance?
- Go to the Barangay Office where you want to register your business.
- Accomplish the Application Form for Business Barangay Permit
- Submit accomplished form with these requirements:
- Certificate of Registration from DTI
- Proof of Address (Contract of Lease or Certificate of Ownership)
- Copy of 2 Valid Government IDs (Passport, License, PRC, SSS, etc)
- Wait for the assessment and PAY for the application.
- Get your Barangay Clearance
One day processing, application fee depends per barangay but shouldn’t be more than Php 1000.

Hi, I’d like to know if we are only limited to DTI when filing as a business. I filed with the SEC since I wanted the business to be a partnership between my wife and I. Is that ok? Or should it be under DTI only as a single proprietor business?
Yes that’s fine. We used DTI here since most partners used sole proprietorship blindly. Just make sure though with SEC the required paid up and subscribed capital for a transportation nature of business.

Depends which address you nominated as your business address.
You’re lucky if your company’s account will handle that for you. You can ask them. But it’s customary that they let you handle that coz it’s your business now not theirs.

Yes. There’s a certain BIR Form that should come from your employer that will be used by your accountant to do your taxes as mixed income earner. We’ll delve more into it in another post. 🙂

Technically, you can team up with other Partner-Drivers (that’s what we did) however, there’s new development that the individual car owners may still need to get individual TNVS accreditation (not sure if this directly translates to individual business registrations. Depends how you want to structure your business. You can have the hired drivers as contractual so you’re not mandated by law to provide benefits but you have to renew contract every 6 months (like how SM does it). There are advantages and disadvantages declaring your drivers as employees or not.

Just make sure your driver has Pro license.
My husband signed up as partner/driver, and the car is under my name,but he is the co-lessee. So the TNVS will be under my name,does that mean that its my tin number that will be used or his? I plan to register Honda Mobilio when I register as partner-operator with Uber. However, I have read that LTFRB requires TNVS vehicles to always display trade dress during pre-arranged rides. May I know what kind of trade dress Uber provides to its partner vehicles? Since Honda is very strict with their vehicles to not be used for public transportation, will it affect my contract with Honda? Will LTFRB or Uber eventually not accept or disqualify Honda vehicles to operate? Hoping for your prompt response. Thank you.
AS of the moment, Uber accepts Uber. Your contract with Honda is between you and Honda.

I don’t have a current ITR but I have a BIR Form 1904 which I got upon applying for a TIN for the first time. Will this suffice? Or should I apply for a new TIN number under my new business name (DTI Permit)? How do I get a Certificate of TIN Registration ba?

Hi Maricar! Since the business is under your name, you have to use your TIN. No need for a new one.
Only one TIN per person. Check with BIR first if you have a TIN so as to avoid having 2 TINS. it’s a criminal offense btw.

I used to operate my business using my personal TIN. Can I open a new TIN account for Uber? My previous business is not operational due to unpaid penalties and I don’t have the new O.R. with the Authority to print (due to accountant negligence).

The one with the CPC franchise (the vehicle owner). As per drivers, it depends on how you structure it; if you declare them as regular employees with above minimum salaries, then yes. But there are other options

1) If we hire a third-party accountant, will he be able to process all the paperwork required (mayor’s permit, baranggay permit, BIR forms, etc.)? And can’t we do the taxes annually instead of monthly?

If sole proprietorship, you have to use your personal TIN since one person can only have one TIN. If partnership or corporation, you need to register for a separate TIN of that business entity

The TIN has to be of the one who registered with BIR (which is the one to whom the Business name is registered to). So it has to be to whom the CPC Franchise is/will be released which is the car owner.

If mixed income, how will the taxable income be computed? Is it gross income from compensation + gross business income minus deductions? If this is the case then chances are the tax you’ll be remitting will be higher if you have a high compensation (from employer). OR will the compensation tax be remitted by your company as is and you’ll just use it as attachment when you pay the business tax. Taxable income computed only based on business income?

Not necessarily those two income taxes are calculated separately. We think that will depend how your accountant structures your expense accounts.

No. e-receipts issued by Uber is just acknowledgement receipts. They are NOT official receipt of the TNVS Partner. We recommend you go through the Terms and Conditions you signed with Uber and look for the section with taxes.

1. As per last Friday news, LTFRB will hold temporary the application for TNVS until further notice? What will happen on our application? What will be the effect as Uber operator/driver?
2. In my previous payment statement, Uber deducted TNVS CPC and PA Processing Fee + PAMI Personal Accident Insurance for NE6867 but this was already de activated and no longer active for almost 2months.. Buy why it’s still getting the TNVS fee? It was deducted in my transaction under code number HBF639 as my plate number. Should it be transfer to my car and not from the de-active ones?
3. I’m planning to re-enroll my account as new Partner Operator/Partner driver under my name and not other’s name. Will Uber get another TNVS CPC and PA Processing Fee + PAMI Personal Accident Insurance?

You can still sign-up and register as a Partner with Uber and submit the requirements so when LTFRB resumes the applications, maipapasa agad ni Uber yung requirements nila. However as per Uber, vehicle activation might be onhold until LTFRB resumes accepting applications. But driver activation (for Uber Match) is still the same.

I’m the owner and already acquired the DTI certificate. Upon application at BIR, i was told to check if Certificate of Registration ba ang kailangan or the BIR form 1701. In one of your posts on requirements to submit for CPC,

Technically, your garage will be your business address as an Uber Partner/ Operator.
